Terms of Service

By accessing or using Sydney AI at getsydneyai.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Sydney AI is operated by G Capital LLC ("we," "us," or "our"). These Terms are governed by the laws of New South Wales, Australia, and we comply with the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the ACL that cannot lawfully be excluded or limited.

You must be at least 18 years of age to use Sydney AI. By using the Service, you represent and warrant that:

• You are at least 18 years old

• You have the legal capacity to enter into a binding agreement

• You will use the Service only for lawful purposes

• All information you provide is accurate, current, and truthful

We reserve the right to terminate accounts immediately if we discover a user is under 18.

Sydney AI is an AI-powered beauty and skincare advisor that provides:

• Personalised skin analysis from photos using artificial intelligence

• Customised skincare routine recommendations

• Foundation and makeup shade matching

• Product ingredient analysis and compatibility checking

• Skin progress tracking over time

• Personalised product recommendations and discovery

The Service is provided for personal, non-commercial use only.

Sydney AI Is Not Medical Advice

The analysis, recommendations, routines, and content generated by Sydney AI are produced by artificial intelligence for informational and educational purposes only. This content:

• Does NOT constitute medical advice, diagnosis, or treatment

• Is NOT a substitute for professional dermatological or medical consultation

• Should NOT be used to self-diagnose, treat, or manage any skin condition, disease, allergy, or other health concern

• May not be suitable for all skin types, conditions, or individual circumstances

Consult a Qualified Professional

If you have or suspect you have a skin condition, allergy, dermatological disease, or any medical concern — you must consult a qualified dermatologist or healthcare provider before following any recommendations from Sydney AI. Sydney AI is not a healthcare provider.

Accuracy Limitations

AI-generated analysis is subject to limitations including but not limited to:

• Variability based on photo quality, lighting, and angle

• Inability to detect underlying medical conditions

• General recommendations that may not reflect your individual biology

• Potential inaccuracies in skin tone, type, or condition assessment

Individual Results Vary

Results described on our platform, in testimonials, or within the application are illustrative only. Individual outcomes may vary significantly. We make no guarantee, representation, or warranty that you will achieve any particular result from using Sydney AI.

Product Recommendations

Products suggested by Sydney AI are AI-generated recommendations based on your skin profile. We are not responsible for:

• Allergic reactions, irritation, or adverse effects from using recommended products

• Changes to product formulations that occur after our recommendation

• Third-party product quality, safety, or availability

Always patch test new products before full use. If you experience any adverse reaction, discontinue use and consult a healthcare provider.

Account Creation

To use Sydney AI you must create an account with a valid email address or sign in with a supported third-party provider. You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activity that occurs under your account

• Notifying us immediately of any unauthorised account access at [email protected]

Account Accuracy

You agree to provide accurate, current, and complete information. We reserve the right to suspend or terminate accounts with inaccurate information.

Available Plans

• Free: Limited features, one skin analysis

• Sydney ($14.99/month or $119.99/year): Full routine, shade matcher, product scanner, ingredient checker, daily tips

• Sydney Pro ($24.99/month or $199.99/year): Everything in Sydney plus progress tracker, unlimited scans, before/after comparison

All prices are in USD unless otherwise stated at checkout.

Billing and Auto-Renewal

Subscriptions are billed in advance. By subscribing, you authorise us to automatically charge your nominated payment method at each renewal date without further authorisation from you. Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled prior to renewal.

All payments are processed securely by Stripe. Applicable taxes may be added at checkout depending on your location.

7-Day Free Trial

New subscribers may receive a 7-day free trial. Only one free trial per person. If you cancel before the trial ends you will not be charged. If you do not cancel before the trial period expires, your subscription will automatically convert to a paid subscription and your payment method will be charged.

Cancellation Policy

You may cancel your subscription at any time through Settings → Subscription & Billing. Cancellation takes effect at the end of your current billing period — you retain access to paid features until that date. We do not provide refunds or credits for partial subscription periods remaining after cancellation.

Refund Policy

Except where required by applicable Australian Consumer Law, all purchases are final and non-refundable. We do not offer refunds for:

• Change of mind

• Partial months or years remaining after cancellation

• Failure to cancel before a free trial converts to a paid subscription

If you believe you were charged in error, contact us at [email protected] within 7 days of the charge. Refunds required by the ACL (including for major failures of service) are not excluded by this clause.

ACL Consumer Guarantees

Under the Australian Consumer Law, you may be entitled to a refund or other remedy if the Service fails to meet a consumer guarantee. This policy does not exclude those rights.

Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price change via email to your registered address or notice within the application. Continued use after the effective date of a price change constitutes acceptance of the new price.

How It Works

Sydney AI offers a referral program where existing subscribers can invite friends. When a referred friend becomes a paying subscriber, the referrer receives one month of free service added to their subscription.

Rules

• One reward per unique referred user

• Referred users must be new to Sydney AI (no prior account)

• Self-referrals are not permitted

• Referral rewards have no cash value and cannot be exchanged for money

• We reserve the right to modify or terminate the referral program at any time with reasonable notice

• Fraudulent referral activity will result in immediate account termination and forfeiture of all rewards

Sydney AI participates in affiliate marketing programs including the Amazon Associates Program and other affiliate networks. We may earn commissions when you purchase products through links in the Service. This does not affect the price you pay.

Our product recommendations are generated by AI based on your skin profile and are not influenced by commission rates. However, you should be aware that affiliate relationships exist between Sydney AI and certain product retailers.

Your Content

You retain ownership of all photos and content you upload to Sydney AI. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process and use your content solely to provide the Sydney AI Service to you. We do not use your photos to train AI models without your explicit consent.

Photo Guidelines

By uploading photos you confirm:

• You are the person in the photo or have the consent of the person photographed

• You are 18 years of age or older (and the subject of any photo is 18 or older)

• The photo does not contain inappropriate, illegal, or harmful content

Prohibited Content

You may not upload photos or content that contain:

• Nudity or sexually explicit material

• Images of persons under 18 years of age

• Content that violates any third party's intellectual property rights

• Harmful, threatening, abusive, defamatory, or illegal content

We reserve the right to remove any content that violates these Terms without notice.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms

• Attempt to gain unauthorised access to our systems, servers, or databases

• Reverse engineer, decompile, or disassemble any part of the Service

• Use automated tools (bots, scrapers, crawlers) to extract data from the Service

• Resell, sublicense, or provide access to the Service to any third party

• Impersonate any person or entity

• Interfere with or disrupt the integrity or performance of the Service

• Use the Service to transmit unsolicited commercial communications (spam)

• Circumvent any feature limits, usage caps, or subscription tier restrictions

• Upload malware, viruses, or other harmful code

Violation of these Terms may result in immediate account suspension or termination without refund.

Our Content

All content in Sydney AI including but not limited to design, text, graphics, logos, software, and AI models is owned by or licenced to G Capital LLC and is protected by copyright, trade mark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

Your Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Sydney AI for your personal, non-commercial use in accordance with these Terms. This licence terminates when your account is terminated or when these Terms are terminated.

Sydney AI integrates with third-party services including Stripe (payment processing), Cloudflare R2 (file storage), Resend (transactional email), Clerk (authentication), and Amazon (product links). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the acts, omissions, or practices of any third-party service provider.

To the maximum extent permitted by law:

• Sydney AI and G Capital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service

• Our aggregate liability for any claim arising from your use of Sydney AI shall not exceed the total amount you paid us in the three (3) months immediately preceding the claim

• We are not liable for any allergic reactions, skin irritation, adverse effects, or injury resulting from following recommendations generated by Sydney AI

• We are not liable for any loss arising from reliance on AI-generated skin analysis or product recommendations

• We are not liable for any loss of data, loss of profits, or business interruption

**Nothing in these Terms limits or excludes any liability that cannot be excluded under the Australian Consumer Law**, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any consumer guarantee that cannot lawfully be excluded.

You agree to indemnify, defend, and hold harmless Sydney AI, G Capital LLC, and our respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or access to the Service

• Your violation of these Terms

• Your violation of any third party's rights (including intellectual property rights and privacy rights)

• Any content you upload or submit to the Service

• Your breach of any applicable law or regulation

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, error-free, or secure

• Results from using the Service will be accurate, reliable, or suitable for your needs

• The Service will meet your individual requirements

• Any errors in the Service will be corrected

Australian Consumer Law

Certain legislation including the Australian Consumer Law may imply guarantees, conditions, and warranties into these Terms that cannot be excluded. Where such legislation applies, our liability for breach of such an implied guarantee is limited, at our option, to: (a) supplying the Service again; or (b) paying the cost of having the Service supplied again.

By You

You may delete your account at any time in Settings → Privacy & Data → Delete My Account. Termination does not entitle you to a refund of any prepaid subscription fees except as required by the ACL.

By Us

We reserve the right to suspend or terminate your account immediately without notice and without refund if you:

• Violate these Terms

• Engage in fraudulent, abusive, or illegal activity

• Are found to be under 18 years of age

• Abuse our referral or promotional programs

We reserve the right to discontinue the Service with 30 days' notice, in which case we will provide a pro-rata refund of any prepaid subscription period remaining after the discontinuation date.

Effect of Termination

Upon termination of your account, your licence to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia.

Dispute Resolution

Before commencing any formal legal proceedings, the parties agree to first attempt to resolve disputes through good-faith negotiation. If a dispute is not resolved within 30 days of written notice, either party may pursue their rights under applicable law.

ACL Rights

Nothing in these Terms affects your rights under the Australian Consumer Law, including your right to make a complaint to the Australian Competition and Consumer Commission (ACCC) or your state or territory's fair trading office.

Class Action

To the extent permitted by law, you agree to resolve any dispute individually and waive any right to bring or participate in a class action, collective action, or representative proceeding.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Email to your registered address at least 14 days before changes take effect

• A prominent notice within the application

Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

Your use of Sydney AI is subject to our Privacy Policy available at getsydneyai.com/privacy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. Our Privacy Policy complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sydney AI regarding your use of the Service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
